Terms of Use
These Terms of Use (“Terms”) govern your use of Storm Window, the companion Apple Watch app, and associated widgets and complications (together, the “App”), provided by SiPhy LLC (“we,” “us,” or “SiPhy”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App. These Terms supplement, and do not replace, Apple’s Standard End User License Agreement, which also applies to your use of the App.
Not a Safety or Detection Device
Storm Window is a forecast-based planning tool. It is not a lightning detector, storm warning system, or life-safety device, and it does not sense real-time atmospheric conditions at your location. All guidance — including the “safe until” window, risk level, and hazard alerts — is derived from third-party numerical forecast data and probabilistic models, which are inherently uncertain and can be wrong, incomplete, delayed, or unavailable. Never rely on the App as your sole basis for deciding whether to be outside during actual or possible severe weather. If you can see lightning or hear thunder, or if local officials issue a warning, follow that guidance instead of, or in addition to, the App.
Third-Party Data Sources
The App’s forecasts, radar, lightning-probability, air-quality, and wind data are sourced from government and commercial providers (including NOAA/NWS services and other forecast APIs) that we do not control and do not guarantee. Outages, format changes, coverage gaps, latency, and inaccuracies in that upstream data can and do occur, and will propagate into the App’s output. We work to detect and correct these issues but cannot promise the App will always reflect the true state of current or future weather.
No Warranty
THE APP AND ALL FORECASTS, VERDICTS, ALERTS, AND CONTENT IT PROVIDES ARE OFFERED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY FORECAST OR ALERT WILL BE ACCURATE OR DELIVERED IN TIME TO BE USEFUL.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SIPHY LLC AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INJURY, DEATH, PROPERTY DAMAGE, OR OTHER LOSS ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP — INCLUDING LOSSES CAUSED BY INACCURATE, DELAYED, OR MISSING FORECAST DATA, MISSED OR MISTIMED ALERTS, OR YOUR DECISION TO BE OUTDOORS DURING ACTUAL OR DEVELOPING SEVERE WEATHER. THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ASSERTED (CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
Assumption of Risk
Outdoor activity during storms carries inherent risk of injury or death from lightning, wind, flooding, heat, and other hazards. By using the App, you acknowledge that risk and agree that the decision to go outside, stay outside, or seek shelter is yours alone. The App is one input among many — including your own observation of the sky, local warnings, and sound judgment — and does not shift that decision, or responsibility for it, to us.
No Professional Advice
Nothing in the App constitutes meteorological, medical, or safety advice from a licensed professional. Coaches, event organizers, and anyone responsible for the safety of others should follow their own organization’s written weather policy and any applicable local or league safety rules, using the App only as a supplementary tool.
Subscriptions
Optional Pro and Pro+ features are billed and managed through your Apple ID account under Apple’s Standard End User License Agreement and the App Store’s terms for auto-renewable subscriptions. We do not process payments directly and are not responsible for billing disputes, which Apple handles.
Changes to These Terms
We may update these Terms as the App changes. Material changes will be reflected by updating the effective date above. Continued use of the App after an update constitutes acceptance of the revised Terms.
